It all went horribly wrong for Koyes MIAH last month when East Herts Council contacted him at his top of the range Shadhona Restaurant to tell him that his Licence was extinct, due to it not being transferred when the last Ltd Co was wound up and the new one took over. Koyes believed he had notified the Council of this change during COVID but the Council had no record. As an emergency, The Licensing Guys submitted a succession of Temporary Event Notices to allow the restaurant to sell alcohol six days a week whilst a completely new Licence was applied for and obtained. Normality has been restored, and all is well!

Sheetal and Jay extended their store into the house next door with all Planning permission already secured. However a neighbour objected to the Variation of their Premises Licence plan, and spent 15 minutes addressing the Panel without touching on any Licensable Activity, mainly concentrating on amenity and the proximity to residential accommodation – an essential feature of any Cornershop – and all related to Planning and not Licensing. The Variation was duly granted with no additional Conditions imposed, save those already agreed with the Licensing Enforcement Officer. Way to go, Team Niha’s!

A rare occurrence in the form of a Personal Licence Hearing. Over a year ago, young Isobel had a terrible night, resulting in a bad decision which ended up with her losing her Driving Licence. However her Boss, Maria, had complete faith in her and backed her in her studies for a Personal Licence. Her application was resisted by the Police, and it ended up in a Hearing before the Licensing Sub Committee. The Committee listened to her explanation, took evidence on her remorse, rehabilitation, work ethic, professionalism, numerous character references and a host of other professional qualifications she has since obtained. They duly granted her Personal Licence as the Police had failed to justify a refusal on the grounds that it would undermine the Prevention of Crime & Disorder Licensing Objective.

Stables Café in Arborfield is an established café bistro which opened in December 2023 and has developed as a community-focused business offering food, coffee and refreshments. The application was to allow customers to purchase a limited range of alcoholic refreshments to accompany food, rather than to change the nature of the premises or create an alcohol-led operation.

The objectors raised concerns regarding public nuisance, parking, noise, deliveries, waste management, hygiene, the proximity of the premises to residential properties and schools, the potential effect on residents’ peaceful enjoyment of their homes, and the suitability of the premises for the sale of alcohol. Concerns were also expressed that the sale of alcohol could change the character of the area and lead to antisocial behaviour.

The Panel gave significant weight to the fact that no responsible authority had made a representation against the application. It further noted that there was no evidence before it of previous licensing enforcement issues, crime and disorder, public safety incidents, public nuisance directly linked to licensable activity, or harm to children arising from the premises. The Licence was therefore granted as applied for.

This successful vineyard, the owners of which now need to bring their produce to market, will operate primarily as an OFF Licence and bona fide pick, pack and dispatch operation for the vineyard. It was a first when a Representor stormed out of a Hearing at Broxbourne Council shouting ‘Foxtrot Oscar!’ at The Licensing Guys, but at least it adds to the variety of our working day. Here Sanni and Ravi SINGH simply sought to extend their licensable hours until a modest 22:00hrs closing, but attracted 32 Representations against the proposal.

However they also obtained the names, signatures, addresses and telephone numbers of 154 local residents who welcomed the move. To say that the Hearing was heated is something of an understatement, but cooler heads prevailed and the Variation was duly granted.

Aberclydach House at Talybont on Usk, BRECON is an impressive 8,840 sq ft country house offering a versatile property with a rich history. The Holden Arms, Haslingden is a former Admiral Taverns Pub and previous Lancashire Pub of the Week, and was described in the local press as being “just a stone’s throw from a local beauty spot, and its dog-loving owners were drawn to the area for its scenic walks. It’s closure in August 2025 was much regretted by its loyal customer base, including the Grane Lane Residents Association.

Unbeknown to the new applicant, the Premises Licence was surrendered by the previous operator, a fact that seemingly only came to light when an application was submitted to update the Licence with a new DPS in advance of this reopening. Therefore Andrew MITCHELL came to The Licensing Guys in order to obtain a new Licence. Concurrent TENs were given so that the premises might operate from their intended reopening day of 26th May 2026. And now the new Premises Licence has been issued, allowing the reopening of this lost gem of a pub.

Opening Hours Extended for Delamere Stores.

Congratulations to Tujen GANESH on the grant of the Variation of the Premises Licence on Delamere Stores in Delamere, Cheshire. Here he wanted to extend his opening hours to 00:00hrs but was resisted by two neighbours who feared about increases in Crime, ASB, Noise and Traffic volumes. Parananthan ‘Niru’ NIRUSHAN recently took over the Premises Licence at 400 High Street, CHELTENHAM. Niru saw that the Licence and Premises appeared to be operating correctly at present and already comprehensively catered for Challenge 25, Staff Training and CCTV. Through The Licensing Guys he applied to extend the hours on the premises from 23:00 to 02:00hrs terminal hour to provide greater accessibility to the public. Due to its current record of compliance, no additional conditions were proposed. Duly the newly varied Premises Licence was granted today unopposed. Congratulations Niru!

Great news to end the week for The Blackmoor Estate in Hampshire!

The Blackmoor Estate has been selling its fruit direct to the public since the 1920s, but in 2022 started to produce cider and apple juice from blends and single varieties of the finest handpicked apples. An immediate success, in 2024 The Licensing Guys assisted with varying the Premises Licence to include an on-site ‘Tap Room’ and online and on-site retail and tour/tasting event activities. Well, it’s safe to say business took off! So much so that only 18 months on, by the Spring of 2026, the event hosting-space needed to be trebled, a larger on-site Tap Room has been developed and a substantial Farm Shop will soon offer a full-time outlet to offer products direct to the public!

We are delighted to have obtained the replacement Premises Licence in minimal time, with no delays, no additional costs and look forward to seeing future developments! This is a great example of how ‘getting the licensing bit right’ can springboard an entire business by supporting growth in a variety of ways.

Here is Justin LIEVESLEY from the excellent Spen Tap in Cleckheaton. He came to The Licensing Guys as the pre-existing Premises Licence on his new business acquisition was constraining the business through restricted hours of opening and enforced closure on two days/week. The added restriction on the use of the upstairs room (ostensibly to avoid noise complaints from the neighbours in the past) was also restricting access, especially for families who enjoy playing board games. 

However the upstairs seating area is a designated quiet space where no music or TV is played. The primary clientele are middle-aged to older patrons who appreciate the quiet, comfortable atmosphere upstairs. Historically the upstairs area had been used for various events, without ANY noise complaints in any case. 

Duly the Variation to extend operating hours and the footprint of the business was granted unopposed this week – so congratulations, Justin!

Further cause for celebration this time for Dhinesh RAMASAMY who wanted to extend the trading and licensable hours on this pre-existing Premises Licence by three hours – two extra hours before and one hour after the current parameters of this Licence.  Following liaison with the Licensing Authority who kindly spoke with the Responsible Authorities in furtherance of our tentative enquiry, it was ascertained that the Responsible Authorities has no objection to this extension of hours in principle.  

The current iteration of the Licence which The Licensing Guys previously obtained is working well and is being operated compliantly and in full support of the four Licensing Objectives.  Therefore, no additional Conditions were proposed, and indeed the extended hours were granted unopposed at the conclusion of the Consultation period this week.

Congratulations to Antony & Jenny BENEDICT from Charworth Ltd who have acquired the former ATS Euromaster site in Chippenham in Wiltshire. Here is another example of unforeseen consequences:  When the accountant advised to wind up one company and proceed with the other, I’m sure that they did not realise that a Premises Licence held by the former would die unless transferred to the successor within 28 days. Such was the situation with the beautiful Bellini Restaurant in MORETON in MARSH in the Cotswolds. Needless to say, The Licensing Guys dropped everything, applied for a new Licence and kept the restaurant trading under a succession of Temporary Events Notices during the interregnum. Duly a new Licence has been issued and the matter has been regularised.  Congratulations, Anastasios!
