If you’ve moved on from a licensed premises but are still named as the Designated Premises Supervisor (DPS) on the Premises Licence, it’s important to act quickly. As the DPS, you remain legally responsible for the sale of alcohol at that premises—even if you’re no longer involved in its operation.
Why It Matters:
The premises cannot legally sell alcohol without a valid DPS in place.
The DPS is accountable for ensuring alcohol is sold lawfully and responsibly.
If issues arise at the premises (e.g. underage sales, disorder), you could be contacted or even held liable.
What You Should Do:
- Notify the Licensing Authority.
You can formally request to be removed as DPS by contacting the licensing authority that issued the Premises Licence. Most councils provide a “Request to be removed as DPS” form online.
- Inform the Licence Holder
You must also notify the Premises Licence Holder in writing within 48 hours of informing the council. Include a copy of the notice you sent to the licensing authority. Advise the Licence Holder to Return the Licence to the Council, and/or appoint a NEW DPS ASAP.
NB You must direct your former employer, the Premises Licence Holder to return the Premises Licence to the Council, or provide a written explanation if that’s not possible, within 14 days.
No Fee is required to stand down as a DPS.
- Keep Records
Retain copies of all correspondence for your records, including emails or posted letters to both the council and the licence holder.
What Happens Next?
Once your removal is processed, the premises must appoint a new DPS before alcohol can be sold.
You will no longer be legally responsible for any licensable activities at that venue.
Removing yourself as DPS is a straightforward but essential step to protect yourself legally and ensure the premises remains compliant. If you’re unsure which Council issued the licence, check your original appointment documents or contact the Council or your former employer directly.
Summary: Remember that if you remove yourself as the DPS, this will remove your former employer’s ability to sell alcohol lawfully – so this is a serious step to take. Do your best to get them to put a new DPS onto their Licence first, but if they do not cooperate, then follow the procedures laid down in this Briefing Sheet.
