Police Assistance in Expelling Individuals from Licensed Premises: The Law Explained

Under the Licensing Act 2003, licensees and their staff have the legal right to refuse entry to or expel individuals from licensed premises if their behaviour threatens the licensing objectives—such as preventing crime and disorder, ensuring public safety, or protecting children from harm.

When Can Police Assist?

Police officers can assist a licensee or their staff in removing individuals from licensed premises when requested, particularly if the person is:

  • Drunk or disorderly
  • Refusing to leave when asked
  • Causing a disturbance or posing a risk to others

Section 143 of the Licensing Act 2003 makes it an offence for a person to:

  1. Fail to leave licensed premises when requested by a constable or an authorised person (such as the licensee or a door supervisor)
  2. Attempt to enter while drunk or disorderly after being refused entry2

Police Powers:

Police officers have the authority to enter licensed premises under Sections 179 and 180 of the Licensing Act 2003.  They may use reasonable force to enter and assist in maintaining order.

If someone refuses to leave after being asked, police can (but do NOT have to) arrest the individual for failing to comply.  The decision remains with the individual officer on whether to exercise that discretion.

Licensee’s Responsibility:

Even without police involvement, the licensee or their staff have the right to:

  • Request someone to leave
  • Explain the reason for the request
  • Appeal for cooperation
  • Confirm refusal
  • Take action (e.g. call police or use trained security staff).
