Here’s a Recap on the Essential Role of a Designated Premises Supervisor (DPS)

Under the Licensing Act 2003, any premises in England and Wales that is licensed to sell alcohol must have a Designated Premises Supervisor (DPS) named on its Premises Licence. This is not a formality—it is a legal requirement and a cornerstone of responsible alcohol retailing.  Why?

1. Legal Authority and Responsibility:

The DPS MUST hold a valid Personal Licence and is legally responsible for authorising alcohol sales on the premises. Without a DPS in place, no alcohol can be sold—doing so would constitute a criminal offence, potentially resulting in an unlimited fine or up to six months’ imprisonment.

2. Day-to-Day Oversight:

The DPS is typically the individual entrusted with the day-to-day management of the premises. They ensure that the business complies with the conditions of the Licence and that the four Licensing Objectives are upheld:

  • Prevention of Crime and Disorder
  • Public Safety
  • Prevention of Public Nuisance
  • Protection of Children from Harm.

3. Key Point of Contact:

The DPS serves as the main point of contact for the Police, Licensing Authorities, and other enforcement bodies.  Their presence ensures that any issues – such as complaints, inspections, or incidents – can be addressed swiftly and effectively.

4. Compliance and Risk Management:

The DPS must ensure that all staff understand and comply with Licensing laws, including age verification, responsible promotions, and the refusal of service to intoxicated individuals.  They are also responsible for ensuring that the premises operate within the terms of the Licence at all times.

5. Reputation and Accountability:

As the public face of the premises in Licensing matters, the DPS plays a vital role in maintaining the business’s reputation and legal standing.  A poorly chosen or underperforming DPS can lead to Premises Licence Reviews, enforcement action, or even revocation of the Licence.

In short, the DPS is NOT just a name on a Licence—they are the linchpin of lawful and responsible alcohol sales.  Appointing the right person, and ensuring they are supported and informed, is essential for any Licensed Premises.

Duties most likely include making sure that all staff are trained, their training is refreshed as up to date and recorded, incident books and refusals registers are present, maintained and regularly checked, and the CCTV is working and regularly checked.
