Features of Pavement Licence

Purpose: Allows businesses to place removable furniture (e.g. tables, chairs, barriers, heaters) on public highways adjacent to their premises for the sale or consumption of food and drink (NOT just alcoholic drinks).

Eligible Businesses: Includes pubs, cafes, bars, restaurants, snack bars, coffee shops, and ice cream parlours.  Businesses must sell food or drink for consumption on or off the premises.

The Application Process is managed by your Local Authority.

Requires a 14-day public consultation followed by a 14-day determination period.  If the Authority does not respond within the determination period, the licence is deemed granted.

Fees:  Capped at £500 for new applications with £350 for renewals.

Duration:  Licences can be granted for up to 2 years and are automatically deemed valid for 2 years.

Planning Permission: Automatically granted alongside the Licence, so NO separate Planning Application is needed.

Furniture Requirements:  Must be removable and used in connection with food/drink service.  Advertising boards and fixed structures are not permitted.

Accessibility: Businesses must maintain clear pedestrian access, considering the needs of disabled users.

Limitations of a Pavement Licence

Geographic Scope: Applies only to England and only to relevant highways (not Crown land or Network Rail property).

Exclusions:  Businesses not selling food or drink (e.g. hair salons) must apply under the Highways Act 1980.

Licences do not permit Road Closures—separate Planning Orders are required.

Enforcement:  Local Authorities can revoke or amend Licences if conditions are breached.  Furniture must be removed if not compliant or if obstructing access.

Alcohol Licensing: A Pavement Licence does not grant permission to sell alcohol – a separate alcohol Licence is required. The Licensing Guys can help with that too
