1. Unauthorised Licensable Activities
Carrying out licensable activities (e.g. selling alcohol) without the appropriate Licence or Temporary Event Notice.
Penalty: Up to 6 months’ imprisonment and/or an unlimited fine.
2. Sale of Alcohol to Children
Selling alcohol to anyone under 18. Includes allowing underage persons to consume alcohol on Licensed Premises.
Penalty: Fines and potential licence review or suspension.
3. Allowing Disorderly Conduct
Permitting drunkenness, violence, or anti-social behaviour on licensed premises. Can lead to enforcement action against the Premises Licence Holder or Designated Premises Supervisor (DPS).
Penalty: Fine up to £1000 and possible Premises Licence Review.
4. Sale of Alcohol to a Person Who Is Drunk
It is an offence to knowingly sell alcohol to someone who is already drunk.
Penalty: Fine up to £1000 and possible Premises Licence Review.
5. Obstructing an Authorised Officer
Refusing to cooperate with police, licensing officers, or environmental health officers during inspections or investigations.
Penalty: Fine and potential criminal charges.
6. Failure to Display Licence Summary
Premises must display a summary of their licence in a prominent place. Failure to do so is a breach of the Act.
7. Failure to Notify Changes
Licence holders must notify the licensing authority of changes to name, address, or Designated Premises Supervisor. Failure to do so may result in enforcement action.
These offences are enforced by Local Authorities, Police, and other regulatory bodies. Breaches can lead to fines, imprisonment, licence suspension or revocation, and reputational damage.
